National Collegiate Lawsuit

Are you facing a National Collegiate Lawsuit here in Texas?

Did you recently find out you're being sued by National Collegiate Student Loan Trust here in Texas? Was your private student loan sold to National Collegiate and now they are taking you to court? If you are facing a lawsuit from National Collegiate over your private student loan, we can help reduce or eliminate your outstanding debt!

The student loan debt relief firm of Johnson & Bryan specializes in National Collegiate lawsuits here in Texas. We've saved our fellow Texans over $21,000,000 and our clients routinely end up paying back less than 11% of their original debt! We're not afraid to take National Collegiate to court, and have done so with many clients. In other instances, we've forced National Collegiate to settle their lawsuit for a substantial discount. Don't let National Collegiate bully you into a default judgment, as they rarely have the necessary documentation to win a private student loan lawsuit.

So who is National Collegiate Student Loan Trust, and how did they end up suing you? If you have a private student loan here in Texas, chances are National Collegiate is involved. This company is not the lender, the servicer or the guarantor of your loan, so why are they filing a lawsuit against you? Well, National Collegiate is actually a series of trusts that contain large portfolios of student loans packaged and sold as investments. Once your loan is transferred to one of the trusts (National Collegiate actually has many student loan trusts), bonds are sold to investors. The investors then make money based on how well you and the other debtors pay back your loan. Pay it all back, and the investors make a lot of money. Don't pay it back, and the investors lose money. Investors don't like to lose money, and this is how you ended up being sued by National Collegiate.

National Collegiate will not hesitate to file a lawsuit against you once you are behind on your student loan payment. Again, their investors want their money back, and they need to continue selling new loans to new investors. If they just let all these loans default, they would quickly be out of business. It's estimated that over 90% of the debt lawsuits National Collegiate file end up as default judgments. This means the debtor never responded to the original lawsuit and got their day in court. When this happens, National Collegiate wins the case against them, receives a judgment, and begins more aggressive collection efforts like freezing bank accounts or seizing assets. Don't give National Collegiate an easy win in your case!

If National Collegiate Student Loan Trust is suing you, chances are it is for a large amount. The good news is that we have had a lot of experience fighting National Collegiate and can almost always lower or eliminate your debt with them. Because of the way National Collegiate operates their business, it can be very hard for them to prove they have a right to sue you in Texas. This is due to the strict rules and regulations in Texas civil courts.

In Texas, National Collegiate must prove several things to win in court:

  1. That you actually signed for the private student loan
  2. That National Collegiate now owns the loan and has a right to collect, and
  3. The amount National Collegiate says you owe is the actual and proper amount due

These requirements are actually quite challenging for National Collegiate because of how much your loan has moved from various institutions before ending up with them. Do they still have the original paperwork from the originating bank that made you the loan? Do they have proof of all the transfers from the originator, to the depositor, to the servicer, and then ultimately to the trust? Can they show every statement and calculation to prove that the interest and fees are correct? Chances are, they can't. So much so that National Collegiate was recently fined by the CFPB and ordered to stop suing on invalid or unverified debts!

The general process for a National Collegiate Student loan lawsuit is the same as for any other debt lawsuit in Texas. You can read a comprehensive overview of debt lawsuits in Texas here on our site. The bottom line is if you have been sued by National Collegiate here in Texas, it is in your best interest to hire an experienced attorney to challenge this lawsuit. The chances are good that we can get the case dismissed, or if nothing else, help you settle the debt for a fraction of the original amount.

Your Options

What you choose to do now can have a big impact on your future.
1

Do nothing, and hope this all goes away

This is what most people choose to do when facing a debt lawsuit. This is the single worst thing you can do for your financial future. If you take nothing else from reading our site, please DON'T CHOOSE THIS OPTION. When you do not respond to your creditors, they will eventually file a lawsuit against you. Once they do, you have between 14-20 days (depending on what court they file in) to respond. If you fail to respond, your creditor will win a "default judgment".

Once a creditor obtains a National Collegiate default judgment, they can begin the process of collecting on the full amount. This is when your creditor will really start to turn the screws. Your creditor will now be legally allowed to seize your non-exempt assets, including freezing your bank account. For certain debts, they will also be allowed to garnish your wages. They can also file title liens against any property you may own. Your creditor can and will take extreme measures to collect this debt. The judgment is good for 10 years, and they can renew it indefinitely every 10 years after. It will never go away. Whatever you do, don't ignore this problem.

2

Represent yourself in court

For the ambitious debtor, this may appear like a reasonable option. We've all had that friend who fought their speeding ticket in court and won. Unfortunately, a civil debt lawsuit in Texas is an extremely complex case. For every story you read online about the little guy who fight the giant banks and won, there are 1000's more you don't hear about that make a simple mistake and lose. Texas civil law is riddled with loopholes and gotchas, with strict paperwork and filing deadlines that challenge even seasoned lawyers. Unfortunately, the law and the odds are stacked against you.

Your creditor has a team of lawyers in every state whose sole job is to sue and collect on unpaid debt (and they make a lot of money doing it). They will show up to court with thousands of pages of documents, and fly in "experts" from across the country, just to win a small judgment against you. Your creditor takes this very seriously, and so should you. The truth is, most people choose this option because they don't think they can afford a National Collegiate lawyer to represent them. That's why we've made our fees simple and affordable, and provide low monthly payment plans, so you can get the valuable legal help you need. Don't pay thousands of dollars in late fees and charges to your creditor, when we can reduce or eliminate your debt altogether.

3

Let us fight on your behalf

Johnson & Bryan is a debt relief law firm that specializes in National Collegiate lawsuits. All day, every day, we represent our clients against these greedy creditors. When you hire us to represent you, we completely take over your National Collegiate lawsuit from start to finish. All collection efforts will stop immediately, including those annoying phone calls. Your creditor will only deal directly with us. We will also file all the necessary documents to challenge your creditor's lawsuit, and attend court for you on your behalf.

Most all of our communication can be handled over the phone or email, so you won't have to miss valuable time at work to deal with this issue. You'll always deal directly with an experienced National Collegiate lawyer at our firm (never a paralegal or outsourced help), and we will keep you constantly updated with the status of your case. We will force your creditor to either dismiss or settle your debt lawsuit, or we will take them to court and make them convince the judge. Bottom line, we will fight tooth and nail to ensure you end up paying the least amount possible on your outstanding National Collegiate balance.

Pricing

Flat rate fees, with payment plans to match your budget.

That fee won't change, regardless of how many phone calls we make, documents we fax, or court appearances we attend on your behalf. We're here to help you resolve your financial situation, not add more debt to your plate.

If you can't afford the total fee upfront, don't worry! We will gladly set up a interest free payment plan with a monthly payment that fits your budget.
